License Agreement

This License Agreement ("Agreement") is entered into between MonoKit, represented by [Insert Representative Name], whose contact information is [email protected], and you, the user ("Licensee"), regarding the use of the MonoKit coding boilerplate (the "Product") available at monokit.dev (the "Website"). By downloading, accessing, or using the Product, Licensee agrees to be bound by the terms and conditions of this Agreement.
1. Grant of License
1.1 Startup License
Subject to the terms and conditions of this Agreement, MonoKit grants Licensee a non-exclusive, non-transferable, and non-sublicensable Startup License to use the MonoKit coding boilerplate for the following purposes:
- Create unlimited projects.
- Build and develop applications, websites, or other software for commercial or non-commercial use.
- Download the MonoKit codebase as a zip file.
- Access the MonoKit Discord community for support and collaboration.
The Startup License includes a license key granting access to MonoKit’s documentation and online course.
1.2 Scale License
Subject to the terms and conditions of this Agreement, MonoKit grants Licensee a non-exclusive, non-transferable, and non-sublicensable Scale License to use the MonoKit coding boilerplate for the following purposes:
- Create unlimited projects.
- Build and develop applications, websites, or other software for commercial or non-commercial use.
- Download the MonoKit codebase as a zip file.
- Access the MonoKit Discord community for support and collaboration.
- Access the MonoKit GitHub repository for version control and updates.
The Scale License includes a license key granting access to MonoKit’s documentation and online course.
1.3 Enterprise License
Subject to the terms and conditions of this Agreement, MonoKit grants Licensee a non-exclusive, non-transferable, and non-sublicensable Enterprise License to use the MonoKit coding boilerplate for the following purposes:
- Create unlimited projects.
- Build and develop applications, websites, or other software for commercial or non-commercial use.
- Download the MonoKit codebase as a zip file.
- Access the MonoKit Discord community for support and collaboration.
- Access the MonoKit GitHub repository for version control and updates.
- Receive personal integration support from the developer, subject to the developer’s availability and time limitations as mutually agreed upon in writing.
The Enterprise License includes a license key granting access to MonoKit’s documentation and online course.
2. Restrictions
Licensee shall not:
- Resell, redistribute, or offer the MonoKit boilerplate as a standalone product or as part of a competing boilerplate or template product.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices included in the MonoKit boilerplate.
- Reverse-engineer, decompile, or disassemble the MonoKit boilerplate, except to the extent permitted by applicable law.
- Use the MonoKit boilerplate in any manner that violates applicable laws, regulations, or third-party rights.
- Sub-license, rent, lease, or transfer the MonoKit boilerplate, license key, or any rights granted under this Agreement to any third party.
- Share access to the MonoKit Discord community, GitHub repository, documentation, or course with unauthorized individuals or entities.
3. Ownership and Intellectual Property
MonoKit retains all ownership and intellectual property rights in and to the MonoKit boilerplate, including its code, documentation, course content, and related materials. This Agreement does not grant Licensee any ownership rights in the Product. Licensee may modify the boilerplate for their own projects but may not claim ownership of the original or modified boilerplate code as a standalone product.
4. No Refunds
All purchases of the MonoKit boilerplate are final. No refunds, exchanges, or cancellations will be provided once access to the Product, license key, or any associated services (e.g., Discord, GitHub, documentation, or course) is granted, consistent with the nature of digital products. Licensee is responsible for reviewing MonoKit’s documentation and system requirements prior to purchase.
5. Updates and Support
The MonoKit license grants access to the purchased version of the boilerplate. Updates, bug fixes, or new features are not guaranteed and may require additional purchases at MonoKit’s discretion. Access to the Discord community is provided for peer support and collaboration, but technical support is limited as outlined in MonoKit’s documentation or purchase agreement. Extended support may incur additional fees. For the Enterprise License, personal integration support is subject to the developer’s availability and agreed-upon time limitations.
6. Third-Party Dependencies
The MonoKit boilerplate may include or rely on third-party libraries, frameworks, or tools, which are subject to their own licensing terms. Licensee is responsible for complying with these third-party terms and ensuring compatibility with their systems. MonoKit is not liable for issues arising from third-party dependencies.
7. Warranty and Disclaimer
THE MONOKIT BOILERPLATE, DOCUMENTATION, COURSE, AND ASSOCIATED SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. MonoKit does not guarantee that the Product or services will meet Licensee’s specific requirements or operate without errors.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MONOKIT SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE MONOKIT BOILERPLATE, DOCUMENTATION, COURSE, OR ASSOCIATED SERVICES (INCLUDING DISCORD, GITHUB, OR PERSONAL INTEGRATION), EVEN IF MONOKIT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In no event shall MonoKit’s total liability exceed the amount paid by Licensee for the Product.
9. Termination
MonoKit reserves the right to terminate this Agreement and the associated license at its sole discretion, with or without cause, by providing written notice to Licensee. Upon termination, Licensee must cease all use of the MonoKit boilerplate, destroy any copies in their possession, and discontinue access to the Discord community, GitHub repository, documentation, and course. Sections 2, 3, 4, 7, 8, and 9 shall survive termination.
10. Entire Agreement
This Agreement constitutes the entire agreement between Licensee and MonoKit concerning the subject matter herein and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings.
