1. Introduction
By using MonoKit, you confirm your acceptance of, and agree to be bound by, these terms and conditions.
2. Agreement to Terms and Conditions
This Agreement takes effect on the date on which you first use the MonoKit boilerplate or software.
3. Perpetual Software License with Termination Rights
The MonoKit Software License grants you a non-exclusive, non-transferable, perpetual license to use the MonoKit boilerplate software through a one-time purchase. MonoKit is designed for developers, entrepreneurs, and businesses to accelerate application development with pre-built, customizable code templates and integrations.
This license provides unrestricted access to MonoKit’s features without recurring fees or subscriptions. However, the licensor reserves the right to terminate this license at any time, with or without cause, at its sole discretion. Upon termination, you must cease all use of MonoKit and destroy any copies in your possession.
By purchasing the MonoKit Software License, you acknowledge the licensor’s termination rights, which ensure flexibility in managing software distribution and addressing unforeseen circumstances.
4. No Refunds
Due to the nature of digital products, all sales of MonoKit are final. No refunds, exchanges, or cancellations will be provided once access to the boilerplate or software is granted. You are responsible for reviewing MonoKit’s documentation, features, and system requirements prior to purchase to ensure it meets your needs.
5. Intellectual Property
MonoKit, including its code, documentation, and associated materials, is owned by the licensor and protected by intellectual property laws. You may not reverse-engineer, decompile, disassemble, or distribute MonoKit, in whole or in part, without prior written consent from the licensor. You are permitted to modify MonoKit for your own projects, but you may not resell, sublicense, or redistribute the boilerplate or its derivatives as a standalone product.
6. Updates and Support
The MonoKit license includes access to the purchased version of the boilerplate. Updates, bug fixes, or new features are not guaranteed and may require additional purchases at the licensor’s discretion. Technical support is provided on a limited basis, as outlined in MonoKit’s documentation or purchase agreement, and may be subject to additional fees for extended assistance.
7. Disclaimer
MonoKit is provided “as is.” It is not warranted that MonoKit will meet your specific requirements or that its use will be uninterrupted or error-free. All express and implied warranties or conditions, including but not limited to loss of profits, data corruption, business interruption, or loss of contracts, are excluded and disclaimed to the fullest extent permitted by applicable law. This Agreement does not affect your statutory rights.
8. Warranties and Limitation of Liability
MonoKit does not provide any warranty, guarantee, or other term as to the quality, fitness for purpose, or otherwise of the software. The licensor shall not be liable for any representation (unless fraudulent), implied warranty, condition, or other term, or any duty at common law, for any loss of profit, indirect, special, or consequential loss, damage, costs, expenses, or other claims arising out of or in connection with MonoKit, whether caused by the licensor’s negligence or otherwise. The licensor shall not be liable for any delay or failure to perform its obligations due to causes beyond its reasonable control.
In the event the licensor is deemed liable for breach of this Agreement, liability is limited to the amount paid by you for MonoKit. You hereby release the licensor from any obligations, liabilities, or claims exceeding this limitation.
9. Responsibilities
The licensor is not responsible for how you use MonoKit or for any user-generated content, applications, or projects built with the boilerplate. You are solely responsible for ensuring your use complies with applicable laws, regulations, and third-party rights.
10. Price Adjustments
As MonoKit evolves with new features and improvements, its price may increase. Any discounts offered at the time of purchase are provided to secure the current price and do not guarantee future pricing.
11. Third-Party Dependencies
MonoKit may rely on third-party libraries, frameworks, or services, which are subject to their own terms and conditions. You are responsible for complying with these third-party terms and ensuring compatibility with your systems. The licensor is not liable for issues arising from third-party dependencies.
